En esa ocasión Rumi Maqui proclamó la restauración del Tawantinsuyu, e inició, con los indios que le eran fieles, la toma de algunas haciendas del altiplano. Debelada la insurrección por el gobierno, Gutiérrez, quien era militar de carrera, fue apresado y conducido a Arequipa para ser juzgado.
