Adopting a rigorous methodological approach in the field of legal science, qualitative and quantitative methods were merged, including surveys, interviews and documentary analysis, to obtain a holistic understanding of the situation. The results highlight persistent challenges despite technological advances, such as gaps in access to online education, restrictions to citizen participation and data protection concerns. In addition, it identifies the existence of online discrimination and cyberbullying cases, which disproportionately impact vulnerable groups. This study underscores the imperative need to address these issues from a legal perspective to ensure equitable digital inclusion and the full exercise of Digital Rights in the Peruvian legal framework, thus providing a solid basis for the formulation of policies and legal actions aimed at promoting equal access and opportunities in the digital environment.La presente investigación se centra en la esfera de los Derechos Digitales, una temática de crucial relevancia en la sociedad contemporánea, con especial énfasis en cómo estos derechos son experimentados y ejercidos por grupos vulnerables en el contexto legal peruano. Adoptando un enfoque metodológico riguroso en el ámbito de la ciencia del Derecho, se fusionaron métodos cualitativos y cuantitativos, incluyendo encuestas, entrevistas y análisis documental, para obtener una comprensión holística de la situación. Los resultados destacan desafíos persistentes a pesar de los avances tecnológicos, como brechas en el acceso a la educación en línea, restricciones a la participación ciudadana y preocupaciones sobre la protección de datos. Además, se identifica la existencia de discriminación en línea y casos de ciberacoso, que impactan de manera desproporcionada a los grupos vulnerables.
