The research aims to contribute to institutional stability, ensuring that presidential vacancy adheres to solid constitutional principles and does not become a discretionary tool in the hands of partisan interests.Este artículo se centra en la interpretación subjetiva de la vacancia presidencial por incapacidad moral en la Constitución peruana, específicamente en el Art. 113. Examina la evolución histórica de esta interpretación, transitando desde la concepción inicial de incapacidad mental hacia un enfoque ético del comportamiento individual. El análisis se enfoca en casos recientes, como los intentos de destituir a Pedro Pablo Kuczynski en 2018 y la vacancia de Martín Vizcarra en 2020, subrayando la amenaza de un uso discrecional de esta causal con fines políticos. El artículo busca proponer soluciones para prevenir interpretaciones arbitrarias mediante reformas legislativas y constitucionales, respaldadas por un análisis casuístico y doctrinario. Se destaca la necesidad de clarificar y objetivar los criterios de incapacidad moral, evitando su manipulación con motivaciones políticas.
