INCORPORACION DE LA CONVOCATORIA A ASAMBLEA GENERAL DE ASOCIADOS COMO PROCEDIMIENTO NO CONTENCIOSO VÍA NOTARIAL

La investigación asumió como objetivo general, elaborar una  propuesta de incorporación el numeral 12 al artículo 1 de la Ley N° 26662 “Ley de Competencia Notarial en asuntos No Contenciosos”. Se analizó la viabilidad de incorporar a los asuntos no contenciosos seguidos en vía notarial,  la convocatoria de asamblea general de asociados para nombramiento de nuevo Consejo Directivo, teniendo en consideración que la situación de acefalia presentada en asociaciones inscritas en los Registros Públicos, a la fecha, no logra ser superado, dado que las gestiones de convocatoria judicial o la reunión de la totalidad de integrantes presentan complicaciones, tales como demora en los procesos judiciales o imposibilidad que todos los asociados pudieran participar en la sesión, pues, basta la ausencia de una persona para desvirtuar su condición de universal. Se utilizaron métodos del nivel teórico y empírico, así como estadísticos, con un paradigma cualitativo – cuantitativo. Las técnicas aplicadas fueron el estudio documental, la encuesta y el cuestionario. Los resultados se corresponden con el aporte práctico de una tesis de maestría, en el cual se elabora una propuesta de incorporación el numeral 12 al artículo 1 de la Ley N° 26662 “Ley de Competencia Notarial en asuntos No Contenciosos”. Abstract The investigation assumed as general objective, to elaborate a proposal of incorporation the numeral 12 to the article 1 of the Law N ° 26662 "Law of Notarial Competence in Non-Contentious Matters". The viability of incorporating non-litigious matters followed by notarial channels was analyzed, as well as the convening of a general assembly of associates for the appointment of a new Board of Directors, taking into consideration that the situation of acefalia presented in associations registered in the Public Registries, to date , does not manage to be overcome, given that the procedures of judicial summons or the meeting of all the members present complications, such as delay in the judicial processes or impossibility that all the associates could participate in the session, because, the absence of a person to distort their status as universal. Methods of the theoretical and empirical level were used, as well as statistical, with a qualitative-quantitative paradigm. The techniques applied were the documentary study, the survey and the questionnaire. The results correspond to the practical contribution of a master's thesis, in which a proposal for the incorporation of numeral 12 into article 1 of Law N ° 26662 "Law of Notarial Jurisdiction in Non-Contentious Matters" is elaborated.  Keyword: Association, Judicial Call, Non-contentious Process, Notary, Board of Directors, Legislative Proposal.
