In this paper I intend to reflect on the inability of functionalist dogmatic currents to contain the ius puniendi of the State. I will also point out what are the reasons of the penal system itself that have led to give the legislator a carte blanche, which has led to an unbridled punitiveness, and what fundamentals are proposed to build a more rational criminal response. By reviewing the current situation of criminal dogmatics, the questions of the method and the object of study of this branch of knowledge, we come to the conclusion of an improper relativism of a knowledge that is intended to be scientific. The rational proposal against this relativism is a criminal policy based on human rights.

In this article, the author discusses economic crimes and argues that corporative spaces create contexts where white collar crimes are normalized. The concept of “white collar crime” is further analyzed, as well as the problems that their prosecution must face, such as a culture that values power and money, the lack of a social conscience of the harmful consequences of this type of crimes and the lack of information in mass media.

A través de este artículo, la autora nos invita a una interesante reflexión acerca de los denominados delitos de cuello blanco, partiendo del origen del término y delineando las consideraciones de orden social y económico en el panorama mundial contemporáneo, las consecuencias de encontrarnos en un mundo globalizado. La contraposición de los delitos cometidos por personas con poder económico frente a aquellos cometidos por personas que no poseen dicho poder cierra este artículo con una importante consideración para el futuro de los delitos de cuello blanco.
