Cases of double sale of property are handled by the supreme court of this country with a diversity of interpretations of the Civil Code. Good faith and the correct systematic interpretation of articles 1135 and 2022 of the Civil Code are important aspects that have been overlooked over the years, despite being essential to provide a coherent solution to this problem.This article dives deeper into this issue. The author urges the development of good faith in the articles mentioned and challenges for good faith interpretation. This article analyzes the national and international regulation of continuous and instantaneous performance contracts, focusing on the incomplete nature of this regulation and its impact on legal certainty.The authors propose a classification based on the role of time in contractual performance and satisfaction of the creditor’s interest. These criteria are presented as more precise to differentiate between continuous and instant performance contracts, facilitating their practical application.

La buena fe del sistema de transferencia inmobiliario, es un requisito necesario para la aplicación de diversas normas del referido sistema, como son los artículos 1135°, 2014° y 2022° del Código Civil. Sus alcances, determinados en la jurisprudencia de la Corte Suprema, han evolucionado con el transcurrir de los años. Desde la emisión del código vigente, hasta el año 2009, existía una interpretación netamente registral de la buena fe. Se exigía únicamente la verificación de la información publicitada por el Registro para actuar con el referido código de conducta.
