Este trabajo de investigación busca a delimitar y sustentar el concepto de la autonomía negocial del Estado peruano en los contratos de Asociación Público Privada desde la conceptualización de la Teoría Normativa del Negocio Jurídico. A través del análisis de casos arbitrales en los que el Perú ha participado se propone una construcción jurídica que permite explicar el cómo el Estado actúa en la celebración, modificación, ejecución y terminación de los contratos administrativos en materia de infraestructura pública que celebra.
