El objetivo general de la presente tesis fue describir la influencia de la agravante contenida en el Art. 4 de la Ley N° 30862 en la desprotección de las víctimas de violencia familiar, Huánuco 2018 – 2019, en cuyo desarrollo se ha efectuado una investigación de tipo aplicada, con un alcance o nivel descriptivo – explicativo, mediante un enfoque cuantitativo y diseño no experimental, la muestra fue obtenida de modo no probabilístico a intención del investigador, que consistió en 6 jueces de investigación preparatoria y 12 fiscales, además de 6 Carpetas Fiscales sobre violencia contra la mujer, delito de lesiones leves Art. 122 – B del Código Penal, tramitados entre el 2018 y 2019, a los que se aplicó la entrevista y análisis de datos, respectivamente; obtenidos los resultados se logró comprobar las hipótesis formuladas. Filing charges is one of the issues that the national case law has considered important, due to the fact that the interpretation or enforcement of the law poses a number of problems related to the precision required to attribute a particular behavior. The implementation of Act No. 30364 –the Act to Prevent, Punish and Eradicate Violence against Women and Family Members-, has not ignored this fact since it meant a positive step taken by the Peruvian State to combat violence against these vulnerable groups and which to a great extent involves the modification of our culture and customs.
