El presente trabajo de investigación tiene por objeto implementar el derecho al consentimiento en el proceso de consulta previa con la finalidad de salvaguardar los derechos colectivos de los pueblos indígenas u originarios, especialmente los que están vinculados a su propia existencia. Asimismo, se encontró una vasta data en la jurisprudencia internacional de los sistemas regionales, instrumentos internacionales, normas legales y normas infralegales que coadyuvaron a fortalecer esta postura. En ese sentido, es relevante mencionar que la aplicación de este derecho en la realidad peruana es viable, pues no solo respeta los derechos consuetudinarios de las comunidades étnicas, sino también los del sector empresarial.

June 27 marks the thirtieth anniversary since the General Conference of the International Labor Organization (ILO) adopted the "Convention 169 on Indigenous and Tribal Peoples in Independent Countries." This multilateral treaty, of which Peru has been a party since 1994, brought with it the state responsibility to adopt specific laws, policies and programs focused on the rights and welfare of indigenous and tribal peoples. Among the scope of the Convention, is the recognition of the right to prior consultation, in this sense, this article provides a critical reflection on its application in Peru.
