El presente artículo pretende abordar la importancia del respeto a la autonomía de la voluntad de las personas que desean dejar, en forma anticipada, -a través de los llamados Testamentos Vitales- directrices o instrucciones referidas a la aplicación o no de un tratamiento médico para su propio cuerpo, en caso de que en el futuro surgiera alguna situación que las incapacitara mentalmente a brindar algún tipo de consentimiento. El artículo plantea el siguiente cuestionamiento: si la persona puede consentir sobre los tratamientos médicos a seguir respecto de su propio cuerpo, ¿qué impide que dicho consentimiento lo manifieste por escrito y de manera anticipada para ser aceptado y, sobre todo, acatado en el futuro, en caso de que no pueda brindar su consentimiento por estar incapacitada mentalmente?

This article outlines the three main factors that, according to the author 's opinion, are crucial for a higher education institution to train high quality professionals in a society where the individual interest often prevails over the collective interest. The career in law is taken as an example - a career that is pursued by thousands of youngsters: future lawyers. The question is, Did all of them received a high quality education that enables them to face the great challenges that we have in our society?

The present work intents to highlight the problematic that appears when it is tried to exert one of the fundamental rights that is clearly recognized in our Constitution: the right of defense. Nowadays we can not deny that despite of the fact that we count on clear concepts on the right: «We all have the right to a defense» and «We all are innocent until proven guilty» (innocence presumption), we are very far from guaranteeing in a legitimate way that all this is fulfilled. The work will explore the regulation of this rights and the problems that we found that contaminates and appear like constant obstacles so that this one can suitably be exerted.
