Esta publicación es un caso de estudio sobre el diseño y ejecución de la gestión pública, describe lo realizado en Indecopi durante los años 2011-2016, a partir de un marco teórico que conceptualiza las políticas públicas de una gestión basada en objetivos y, posteriormente, las contrasta a la luz de las metas trazadas de cara a lo que son las nuevas exigencias del país, en un mundo globalizado.

Indecopi no es solamente una agencia de competencia, es también una agencia de protección al consumidor y de protección de la propiedad intelectual. Su mandato parte del precepto constitucional que establece que la libre iniciativa privada es ejercida en una economía social de mercado en la cual el Estado se convierte en promotor y regulador de la competencia con el fin de alcanzar el bienestar de la sociedad. Este artículo resume la forma cómo se articulan las competencias del Indecopi de cara a la libre competencia y al bienestar que la sociedad demanda.

Se presentan propuestas para fortalecer la acción de las Comisiones de Eliminación de Barreras Burocráticas y trabajar en proyectos específicos para coadyuvar a que la labor del Indecopi tenga un mayor impacto. Asimismo, se indican propuestas para fortalecer la gestión pública a través del trabajo de análisis ex – ante de barreras que pueden resultar innecesarias y el fomento al uso del Análisis de Impacto Regulatorio como medio para asegurar la transparencia y razonabilidad de las normas que regulan la actividad privada. Finalmente, se presentan propuestas para impulsar el registro de marcas y fortalecer el control de barreras no arancelarias al comercio exterior.

El presente artículo nos muestra una síntesis breve de la aparición de los organismos reguladores ennuestro ordenamiento jurídico, sus inicios y funciones: supervisar, regular, normar, fiscalizar entre otras reguladas en la Ley Nº 27332. This research aims to conceptualize governance as part of a crucial institu tional transformation process to address environmental challenges. In this context, a specific focus on water management and its relationship with in tegrated water resources management is highlighted. Furthermore, the need for water resources administration, led by the National Water Authority, to evolve towards an inclusive approach that strengthens institutions and, con sequently, environmental governance is emphasized. Finally, it is concluded that strengthening institutions is fundamental to improving governance, with a special emphasis on new water management regulations.

With the entry into force of the Constitution of Peru of 1993, the economic model of social market economy, which was accompanied by an institutional reform, creating four (4) regulators of utilities and one (1) competition agency, was established. The economic model of social market economy, guarantees free competition in the market as a general rule, establishing a regulatory framework for public services that before the reform, were managed directly by the State. Thus, in this paper we will learn how to set up the Peruvian institutional framework and what are the main similarities and differences between competition and regulation, for which we will detail the functions of the competition agency and regulatory bodies as well as interaction between the two.

This institutional design has the advantage of being able to see more clearly what are the points of convergence between the two subject-matter, harmonize them and achieve the goals they have in common. Within this convergence, there are sensitive issues as the granting of compulsory licenses. In this work, we highlight that compulsory licenses are exceptional measures and, to consider its granting, the State must have a procedure that provides confidence and predictability to citizens and clear definitions of what is meant by public interest, emergency and national security. Finally, it is proposed that the granting of compulsory licenses should be justified by a cost benefit analysis showing that is the best choice.

En el derecho –y esto por un precepto elemental de justicia- no suelen existir los absolutos, porque normalmente conllevan a arbitrariedades. Fácilmente identificamos ello cuando, por ejemplo, nuestro derecho de tránsito se ve limitado por cuestiones de orden público (como la declaratoria de un estado de excepción) o nuestro derecho a participar de la vida política del país se encuentra regulado a lo que una norma exprese al respecto (como lo hace la ley orgánica de elecciones).
