This article contains a historical summary of the debates generated in the country around the participation of workers. Takes as object of analysis the discussion produced from the initiative or promulgation of laws that recognize the right of the workers to participate in the benefits of the enterprise and its direction. The purpose of the article is not to bring back past discussions but to contribute to the knowledge of the goals and consequences derived from the regimes of participation. It also tries to clarify the role of law and the State in the legislative process and the influence that the groups of power can have in the gestation of laws.

This paper addresses with the relationship between company unions and the industrial community, insofar as both figures represent the workers' collectivity. The author specifies the differences in the modality of creation, objectives, composition and their normative frameworks; highlighting that the will and obligatory nature in their conformation as a characteristic and distinctive element. Finally, the author emphasizes that their interests may coincide; however, the purpose of the figures is not to supplant or subtract participation from each other. In view of the above, the author emphasizes the importance of both figures acting in a coordinated manner to achieve their objectives.

In 1973, the unveiling of the Social Property Project marked a significant milestone in Peru's social policy landscape, particularly in the realm of business. This initiative brought about notable deviations from the prevailing labor regime. This article endeavors to dissect the newly introduced labor framework outlined in the draft bill and propose enhancements for its refinement. The analysis is structured around three pivotal themes: remuneration, labor rights, and the establishment of trade unions. By juxtaposing the conventional labor regime with the new one, this study aims to delineate the alterations implemented and elucidate the rationale behind these modifications.

El presente artículo contiene un recuento histórico de los debates generados en el país, en torno a la participación de los trabajadores. Toma como objeto de análisis la discusión producida a partir de la iniciativa o promulgación de normas legales que reconocen el derecho de los laborantes a participar en los beneficios y dirección de las empresas. Su propósito no se limita a desempolvar discusiones de otras épocas sino a contribuir al conocimiento de los objetivos y consecuencias buscados o derivados de los regímenes de participación videntes. Intenta, además, aportar al esclarecimiento del rol del derecho y del Estado en el proceso legislativo y a la influencia que puedan tener en la gestación de normas jurídicas las acciones de los grupos de poder.
