El autor estudia el régimen de responsabilidad patrimonial de la Administración pública en el ordenamiento peruano, partiendo de las relaciones que guarda éste con el régimen de expropiación forzosa y las garantías que ofrece para hacer frente a los daños derivados de la actuación administrativa. En este contexto, el autor advierte las deficiencias adjetivas que este régimen padece en sede judicial y propone su reforma para lograr un régimen eficaz de responsabilidad patrimonial en un contexto de cada vez mayor intervención pública sobre los particulares.

This article addresses the general conceptual framework of administrative oversight and the heterogeneous development that it had at the regulatory level in the Peruvian system until 2016. To address this heterogeneity, this study recounts the legal attention that this activity has received. On the one hand, under the 1979 Constitution, according to which the administrative oversight had to adjust to the prevailing Entrepreneurial State model in that period. On the other, from the 1993 Constitution to the present day, during which the administrative oversight has not only had to be strengthened and specialized, but has demanded an organizational transformation in the Peruvian State, to the point of collecting common provisions for the exercise of this administrative power in Law No. 27444.

This paper explores the principle of horizontal subsidiarity in the Peruvian legal system, highlighting its importance as a fundamental pillar to balance state intervention and individual freedom in the economy. Starting with the explicit enshrinement of this principle in Article 60 of the 1993 Constitution, the study analyses its application and the challenges it faces in practice, particularly in the economic and social spheres. The paper reviews the historical and doctrinal evolution of the concept of subsidiarity, from its roots in classical political philosophy to its development in the Social Doctrine of the Catholic Church, and how these influences are reflected in Peruvian regulations. The author studies the protection that the liability of public administration regime offers against Public Administration’s actions in Peruvian Administrative Law. In this context, he notes the shortcomings of such regime and proposes Peruvian legislation must change in order to overcome this weakness. Finally, the author notes that it is necessary to change this regime in order to guarantee effective economic protection against illegal decisions of the Regulatory State.

El presente artículo aborda el marco conceptual general de la fiscalización administrativa y el desarrollo heterogéneo que tuvo a nivel normativo en el ordenamiento peruano hasta el año 2016. Para abordar dicha heterogeneidad, este estudio realiza un recuento de la atención jurídica que recibió esta actividad, por un lado, bajo la Constitución de 1979, de acuerdo a la cual la fiscalización tuvo que ajustarse al modelo de Estado empresario imperante en dicho periodo; y, por el otro, a partir de la Constitución de 1993 hasta la actualidad, donde la fiscalización no solo ha debido fortalecerse y especializarse, sino que ha demandado una transformación organizacional en el Estado peruano, al punto de recogerse disposiciones comunes para el ejercicio de la misma en la Ley No 27444.

The forced expropriation has been, since the origins of the Peruvian Republic, a useful mechanism for the Government to meet its objectives, at the expense of the lawful damage inflicted to the private actors, conferring a fair compensation in return.In this article the current Peruvian legal regime of forced expropriation is studied, for which purpose both authors compare it with the regulation in the earliest Peruvian constitutions and laws, discovering that the concept has not always been designed in the same way by the constituent or the legislator.

The authors propose the revision of the legal problem of administrative inactivity in the Peruvian legal system and the consequences of the responsibility derived from said omission, understood as the unlawful breach of a legal duty of action or of the administrative functions assigned to public entities. For this, the concept of administrative inactivity, its typology and the patrimonial responsibility attributable to the Public Administration as a result of such omission, inertia or passivity is reviewed. The analysis concludes with the procedural problem of the requirement of the patrimonial responsibility to the Public Administration, derived from the notable deficiencies of Peruvian Law that regulates the contentious-administrative process.

Los autores proponen la revisión de la problemática jurídica de la inactividad o pasividad administrativa en el ordenamiento jurídico peruano y las consecuencias de la responsabilidad patrimonial derivadas de dicha omisión, entendida como el incumplimiento ilícito de un deber legal de actuación o de las funciones administrativas asignadas a entidades públicas. Para ello se pasa revista al concepto de inactividad administrativa, su tipología y a la responsabilidad patrimonial imputable a la Administración Pública como resultado de dicha omisión, inercia o pasividad. Se cierra el análisis con la problemática procesal de la exigencia de la responsabilidad patrimonial a la Administración Pública, derivada de las notables deficiencias de nuestra Ley que regula el proceso contencioso-administrativo.
