Esta investigación analiza la figura contenida en el Artículo 22 del Decreto Supremo N° 040- 2014-EM, una figura que, creada en el 2014, no ha sido utilizada todavía y genera muchas interrogantes. Contempla el escenario en que el titular de un proyecto minero con instrumento de gestión ambiental (IGA) aprobado (actividades de explotación y beneficio), transfiera u otorgue en cesión todas sus concesiones mineras, o bien (es decir, excluyentemente) la concesión de beneficio, habilitando al adquirente o cesionario a utilizar el mismo instrumento de gestión ambiental original, siempre que se haya obtenido la aprobación de un procedimiento de modificación sobre dicho IGA.
