Este principio no ha sido desarrollado de manera cabal por nuestra legislación ni por nuestro Tribunal Constitucional a la hora de aplicarlo a sus resoluciones constitucionales, ya que no podemos encontrar una definición del mismo, así como la extensión de sus alcances ni los límites en su aplicación en los procesos constitucionales

In this article, the authors analyze the state of the constitutional justice system in Peru and its importance in the protection of human rights and the defense of democracy at the national level. Likewise, from the perspective of art and law, the authors establish a simile between Peruvian constitutional justice and Batman, the dark knight, a famous character from DC Comics who embodies the struggle for just causes.

The objective of this study is to analyze the constitutional reform proposal on the right to decent housing, presented by the author before the Congress of the Republic of Peru. This proposal was materialized through Bill No. 05839/2020-CR, which seeks to incorporate the Fundamental Right to Decent Housing in the Political Constitution of Peru. The intention of this proposal is to include numeral 25 in Article 2° of the Peruvian Constitution, in order to integrate the fundamental right to decent and adequate housing in the set of rights explicitly recognized by the Peruvian Magna Carta, so that the State can implement the necessary actions and measures to guarantee its access. ¿Cuál es el rol del sistema de justicia constitucional peruano en el Estado democrático? ¿Por qué es importante? ¿Cómo se le puede relacionar con Batman? En el presente artículo, los autores analizan el estado de la cuestión del sistema de justicia constitucional en el Perú y su importancia para la protección de los derechos humanos y la defensa de la democracia a nivel nacional. Asimismo, desde la óptica del arte y el derecho, realizan un símil entre la justicia constitucional peruana y Batman, el Caballero de la Noche, famoso personaje de DC Comics que encarna la lucha por las causas justas.

La protección de los derechos económicos, sociales, culturales y ambientales (DESCA) a través de los procesos constitucionales cobra relevancia en un Estado constitucional de derecho, frente a la vulneración o amenaza de afectación por parte del Estado o de particulares. Decimos ello porque, en el desarrollo jurisprudencial del Tribunal Constitucional, se ha corroborado que dichos medios procesales son idóneos para garantizar tales derechos. Los citados pronunciamientos deben guardar coherencia y correspondencia con las sentencias expedidas por la Corte Interamericana de Derechos Humanos, considerando que, recientemente, se reconoció la justiciabilidad directa de los DESCA. Para ello, se analizó cuidadosamente la normativa y evolución jurisprudencial a nivel nacional y supranacional.

El presente artículo nace con el objetivo de explicar cómo la inteligencia artificial (IA) representa una amenaza para el derecho a la autodeterminación informativa y los derechos conexos a esta, como son los derechos a la imagen, a la identidad personal, al nombre, y a la protección de datos personales. Peasant and native communities have been at a disadvantage in their development expectations due to deficiencies in sectors such as infrastructure and health, which demonstrates the need for public policies focused on allowing access to basic services and the exercise of the fundamental rights of each individual belonging to these communities.
