La fragmentación del Derecho Internacional se ha presentado como uno de los problemas más discutidos a nivel de artículos, libros, conferencias y otros, entendiéndose como tal al fenómeno que se deriva de la mundialización, que ha derivado, a su vez, en un alto grado de especialización técnica, desembocando lógicamente en la celebración de tratados especializados a nivel multilateral y la constitución de organizaciones internacionales específicas. A partir de ello, nuevas áreas del Derecho Internacional se han desarrollado, creándose regímenes especializados para los Derechos Humanos, el Derecho Medioambiental, el Derecho del Mar, entre otros. Even though some legal systems acknowledge the right to a healthy environment as a fundamental right, this acknowledgment is not universal yet. In this article, we explore the relationship between the right to a healthy environment and human rights; its status and its approach to be recognized in the international human rights system.
