El presente artículo se refiere a la implementación de la protección de los datos de prueba para productos farmacéuticos a propósito de la implementación del TLC suscrito entre el Perú y Estados Unidos de América y la aplicación de las definiciones dadas por el TRIPS para esta figura. Se analiza la legislación nacional y los tratados aplicables así como los primeros casos de protección a las nuevas entidades químicas dadas por la autoridad regulatoria. Los aciertos y desaciertos de la nueva legislación de datos de prueba; y su impacto en temas de salud.

La presente exposición se refiere a la implementación de la Protección de los Datos de Prueba para productos farmacéuticos a propósito de la implementación del Tratado de Libre Comercio suscrito entre el Perú y Estados Unidos de América y la aplicación de las definiciones dadas por el Acuerdo sobre los Aspectos de los Derechos de Propiedad Intelectual Relacionados con el Comercio (TRIPS, por su siglas en ingles) para esta figura.
