La presente investigación determinó los principales factores que dificultan el recaudo de los medios probatorios, en la investigación preliminar por denuncias de violencia familiar, tramitadas en la fiscalía de familia de la provincia de la provincia de Jaén del Distrito Judicial de Lambayeque, en el año 2012-2014. La investigación buscó establecer si la falta de un equipo multidisciplinario y la falta de colaboración de la víctima estarían asociadas a la ineficacia de la Ley 30364 en la provincia de Jaén, año 2017. Se analizaron 618 expedientes y se utilizó la técnica de análisis documental. La investigación buscó establecer si la inadecuada la valoración de los elementos del juicio de credibilidad impide superar la retractación de las víctimas en delitos de violación sexual en la Sala Descentralizada Mixta y de Apelaciones de Jaén, periodo 2015-2017.
