This article discusses the possibilities of studying criminal networks as well as the relationships established between their members and the strategies and practices that characterize their actions; in particular, through the case of the former Regional Governor of Ancash, César Álvarez, who has been sentenced and continues to be prosecuted for crimes against the public administration. El objeto de esta tesis es comprender el fenómeno jurídico en los contextos de pobreza, contextos para los cuales se legislan en el Perú instrumentos de lucha contra la pobreza tales como el Programa Estatal de ayuda a los más pobres “Juntos”1 . Para una adecuada comprensión de dicho objeto, hemos depurado de sesgos ideológicos conceptos como Pobreza, Derecho y Derechos Humanos a partir de un trabajo de campo en una localidad peruana de extrema pobreza. Con el fin de generar mejores políticas y normativas de lucha contra la pobreza, este trabajo intenta finalmente reinterpretar y vincular los mencionados conceptos desde una perspectiva humanista, es decir centrada en el valor del ser humano.

El objeto de esta tesis es comprender el fenómeno jurídico en los contextos de pobreza, contextos para los cuales se legislan en el Perú instrumentos de lucha contra la pobreza tales como el Programa Estatal de ayuda a los más pobres “Juntos”1 . El objetivo de este artículo es contrastar la vigencia normativa del principio de la gestión integrada de los recursos hídricos (GIRH), incluido en la Ley Nº 29338 de 2009, con lo que ocurre en tres paisajes hídricos del país: el acuífero de Ica-Villacurí, la cuenca del río Tambo-Ica (Huancavelica) y la irrigación de Olmos (Lambayeque). Estos casos son analizados a la luz de la problemática global del agua y de los desarrollos normativos sobre la GIRH en la regulación del agua en el Perú; así como, a partir del aporte del antropólogo James Scott sobre los “esquemas estatales fallidos”, se explica cómo el principio de la GIRH se evapora en dichos paisajes hidrosociales.

The aim of this paper is to study the effectiveness of the integrated waterresources management (IWRM) principle, included in the Law Nº29338 of 2009, in three hydrological Peruvian landscapes: the aquifer of Ica-Villacurí, the upper basin of the Tambo-Ica River (Huancavelica), and the Olmos watering (Lambayeque). The analysis consists in a review of the context on water resources challenges for the country and the world and an appraisal of the advancement of IWRM in the current water management Peruvian legal framework. Also, considering James Scott anthropological perspective on “governmental failed schemes” we discuss the little effectiveness of IWRM principle in these three hydrological landscapes.
