Universities are special transcendent for the development of our country. However, very little attention has been taken into their legal regimen and the consequences derivate from their preexisting condition of legal entities and independent of the type of universities that constitute. Within the framework of the controversy generated by the new University Law (Law 30220), this article is enlightening in terms of its applicability, since the author presents his proposal based on a complete analysis of the universities, from a constitutional perspective, as from a legal and practical.

El Derecho Laboral es una rama que ha generado mucha polémica en nuestro país, pues mientras  algunos  sectores  consideran que presenta una rigidez que limita al sector privado, otros consideran que es muy flexible y no protege adecuadamente al trabajador.En esta entrevista, el autor nos ilustra sobre la normativa laboral y su impacto a lo largo de los últimos años, desde las reformas laborales que se llevaron a cabo cuando ocupó la cartera del entonces Ministerio de Trabajo y Promoción Social hasta la aprobación de la reciente Ley del Servicio Civil.

What do the current Constitutions of Bolivia, Ecuador, Colombia and Venezuela   have in common? These are all part of what is known asthe new Latin American constitutionalism, a recenttheory  of  Constitutional  Law  that  offers  a new approach to analize the role of constitutionalism inthe present times.THĒMIS-Law Review had the opportunity to interview the main representative of this Latin American constitutionalism, with regard to what this new proposal is about, the solutions it presents, the challenges it faces, as well as the reading it offers about constitutional phenomenons and Constitutional Law institutions.

What is the normative status of a treaty in Peruvian domestic law? What would happen at theinternational level if the Peruvian ConstitutionalCourt declared  a treaty to be unconstitutional? How to interpret Peruvian maritime domain, asrecognized in our Constitution, after the ruling of the International Court of Justice on the maritimedifferendum with Chile?These issues don’t only concern Constitutional Law; thus, in this interview, the renowned professor provides us with, from the standpoint of International Law, answers about these and other issues, but he also illustrates us about the implications for Peru of the aforementioned Court’sruling, delivered more than a year ago.

Whichis  the  role  the Constitutional  Court  shall  havetowards it? What is the importance of arbitrationin relation with domestic and foreign investments?In the present article, the author provides answers to the aforementioned questions.  In  that  line, he mentions recent pronouncements of the Constitutional Court regarding the matter, and gives us his opinion about controversial issues that may arise.

The concern for the rights of people with disabilities is not an issue unrelated to Labor Law. From the ban on firing a worker with a supervening disability to permissions for medical treatments, the fact is that Labor Law has provided various special protections.However, recent regulations provide additional protection for people with disabilities: The New Labor Procedure Act and the Regulation of the General Law on Persons with Disabilities. In this interview, the subject of the duties imposed to the employer is treated, as well as their implications on labor relations.

Se dice que “así como tenemos derechos, tenemos deberes“ o que “a todo derecho le corresponde un deber“. ¿Esto es cierto? ¿La Constitución consagra deberes igual de exigibles que los derechos?
