Este trabajo pretende ser una reflexión acerca de los fines y límites que tiene el Estado en su rol promotor de la cultura y otras manifestaciones que buscan el desarrollo de los individuos. Se explora el modo en que esto puede afectar el principio de neutralidad estatal y derivar en posibles intromisiones perfeccionistas por parte del Estado. Asimismo, se valoran los sentidos y alcances que puede tener la idea de neutralidad y su compatibilidad con los fines que se persiguen en un Estado constitucional de derecho, de cuño liberal pero que busca también el bienestar general. Las reflexiones se llevan a cabo a partir de los modelos propuestos por algunos autores, como Joseph Raz, John Stuart Mill y Martha Nussbaum.

This article takes an approach to parody and its implications for intellectual property law, with a particular focus on copyright and trademark law, highlighting the relevance of its scope in the context of freedom of expression. Within this framework, the authors address the main debates on parody in both the continental intellectual property system and the North American copyright system. On the basis of this analysis, they evaluate the problem in the Peruvian context, where they highlight the progress made in copyright law, but also point out the existing deficiencies. Consequently, this work provides relevant criteria that allow us to understand the scope and limitations of parody in relation to intellectual property rights and freedom of expression.

La quinta edición de los anuarios de investigación del CICAJ-DAD reúne artículos de diversas ramas del derecho, los cuales son producto de un proceso de reflexión académica en torno a temas que son materia de debate en la actualidad.
