“Self-plagiarism” is a figure provided in the academic and scientific field to describe the behavior of authors consisting of “plagiarizing themselves”, something that would occur when an author publishes a work whose content coincides with that of another work by the same author previously published, without citing the previous work. Unlike plagiarism, self-plagiarism is not regulated by law, it is only provided for by regulation through guidelines from scientific journals and educational institutions. In this regard, the possibility of legislatively regulating self-plagiarism within the copyright regulations is proposed in this paper, so that authors have a clear regulatory framework that facilitates their research and publication task.

El objetivo del presente estudio fue analizar la percepción de la comunidad jurídica sobre el autoplagio y la necesidad de su regulación en la normativa nacional sobre derechos de autor. En cuanto a la metodología utilizada, la presente investigación es aplicada y tiene un enfoque cualitativo; asimismo se emplearon los diseños fenomenológico y teoría fundamentada. De igual modo, se empleó la entrevista como técnica de recolección de datos, aplicándose la misma a nueve abogados especialistas en derecho de la propiedad intelectual. De los resultados obtenidos en la presente investigación se concluye que sí es necesario regular legislativamente la figura del autoplagio dentro de la normativa sobre derechos de autor a fin de establecer con claridad qué tipo de conductas deben permitirse y cuáles no.
