In this article, the author presents an analysis of the positive and negative aspects of state planning in the electricity and natural gas sectors. In both sectors, it indicates how the planning intervention by the State has been strengthened over the years. The Peruvian electricity market operator is COES, it is a private company under public law, composed and governed by generators, transmitters, distributors, and the Free Users. The Board of Directors, which is the final authority, makes its decisions without any government intervention. Disagreements with COES decisions are resolved through Arbitration at Law or Arbitration of Conscience. Peru has a significant arbitration practice against the electricity market operator decisions (COES). This is evidenced by the Awards issued during the period 2010-2023. El Perú respecto a la masificación del gas natural aún tiene un largo camino por recorrer, nuestraprimera experiencia fue el Proyecto Camisea para el cual se implementaron una serie de medidas de legislativas que hicieron atractivo el sistema de transporte, como la Ley Nº 27133 que establece mecanismos de garantía para el concesionario del sistema transporte de gas. actualmente el reto es mantener y promover las nuevas inversiones que emplean mayoritariamente el Proyect Finance como técnica de financiación. ante este panorama, los autores analizan el modelo de regulación economía que el estado, con la tarifa Única de Gas Natural-tUNG, adopta a fin de obtener la eficiencia del mercado de transporte de Gas Natural y promover la inversión en el sector.

La regulación sectorial y el derecho de la competencia viven en una permanente tensión. Desde el precedente Trinko, en EEUU se ha optado por excluir la aplicación del derecho de la competencia frente a la aplicación de la regulación sectorial. No obstante, a partir del caso Deutsche Telekom, a nivel de la Unión Europea se ha decidido que el derecho de la competencia se utiliza para llenar los vacíos o, inclusive, corregir los errores de la regulación sectorial. En la tesis se analiza este conflicto, aprovechando la experiencia del sector eléctrico.
