El presente artículo analiza el proceso constitucional de acción popular seguido contra la inclusión del enfoque de género en el Currículo Nacional de Educación Básica. A partir de la información del expediente judicial, se explica el desarrollo del proceso, la posición jurídica asumida en torno al referido enfoque por la parte demandante, la parte demandada (el Poder Ejecutivo), y los jueces que conocieron y resolvieron el caso en dos instancias, incluyendo el pronunciamiento final de la Sala Constitucional y Social Permanente de la Corte Suprema de Justicia. In Peru, the Constitutional Court has jurisdiction to resolve unconstitutionality and conflicts processes in a single instance, and must do so through the interpretation of constitutional norms, as it is the highest body of control and interpretation of the Constitution. The present paper analyzes the guarantees and minimum faculties related to the right to physical liberty in Peru, from the perspective of the Constitution, the Code of Criminal Procedure, the Constitutional Court and international treaties, such as the American Convention. on Human Rights, the International Covenant on Civil and Political Rights, among others. In this sense, in the first place, the prohibition of illegal detentions is developed. The Constitution establishes that the deprivation of physical freedom can only occur in cases of flagrante delicto and in the cases provided by law. The judgments of international courts, such as the Inter-American Court of Human Rights, not only guarantee the protection of fundamental rights, but also provide an insight into the functioning of the Inter-American system for the protection of human rights. The examination of this case not only provided insights into the death penalty imposed on 31 persons under the Crimes Against the Person Act enacted by the respondent State, but also reflected on the procedure of these cases before the Inter-American Court to address human rights violations. The author evaluates the preliminary objections, provisional measures, the procedural institution of joinder of cases, and the judgment on the merits. This analysis is intended to reflect, in addition to the previously mentioned issues, the crucial work of the Inter-American Court in the context of the Inter-American system.

The judgments of international courts, such as the Inter-American Court of Human Rights, not only guarantee the protection of fundamental rights, but also provide an insight into the functioning of the Inter-American system for the protection of human rights. The examination of this case not only provided insights into the death penalty imposed on 31 persons under the Crimes Against the Person Act enacted by the respondent State, but also reflected on the procedure of these cases before the Inter-American Court to address human rights violations. The author evaluates the preliminary objections, provisional measures, the procedural institution of joinder of cases, and the judgment on the merits. This analysis is intended to reflect, in addition to the previously mentioned issues, the crucial work of the Inter-American Court in the context of the Inter-American system.
