En el presente artículo, el autor analiza las características de la lucha contra Sendero Luminoso, llegando a la conclusión de que lo vivido aquí fue un conflicto armado interno, debido a la intensidad y la compleja organización del grupo subversivo. Posteriormente, evalúa cuáles son las consecuencias de esta determinación, ofreciendo una visión alternativaa las actualmente imperantes en nuestro país.

In this article, the authors analyze the reception of the judicial doctrine of the void ab initio of internal amnesty laws contrary to the Inter-American Convention on Human Rights, set by the Inter-American Court since the Barrios Altos case.In these order of ideas, the various social and political processes developed inside the countries attached to this international court are taken into account, who would be the receivers of the court’s decisions’ content. However, as pointed out by the authors, each nation’s context has ended up in a particular assimilation and even a sharp opposition from the national authorities to this judicial doctrine.

In the last few years, an ever growing number of States have recognized same-sex marriage. For that reason, it is important to ask what would happen if two same-sex individuals that have legally contracted marriage in another countrywould sue for its recognition in Peru. The authors of this article study the courses ofaction available to legal operators facing this situation, in the context of the public policy exception and International Human Rights Law.For that purpose, they analize European and Inter-American case-law on the matter and offer a way forward on how to solve conflicts between foreign law, domestic law, and human rights.

This article studies the approach of Inter-American Law and the Inter-American Court of Human Rights to the limitations on the right to run for popularly elected positions, with special emphasis on the regulations of Peruvian Electoral Law on the exclusion of candidates. The article proposes an interpretation that allows the practice of the States to reach a consensus with the text of Article 23 of the American Convention, which at first sight seem incompatible, offering a legal theory that allows to overcome what the authors consider to be a situation of relative unpredictability.

El presente artículo estudia la aproximación del Derecho Interamericano y la Corte Interamericana de Derechos Humanos a las limitaciones al derecho a postular a cargos de elección popular, haciendo especial énfasis en las normas del Derecho Electoral peruano sobre exclusión de candidatos. El artículo propone una interpretación que permita consensuar la práctica de los Estados con el texto del Artículo 23 de la Convención Americana, a primera vista incompatibles, ofreciendo una teoría jurídica que permita superar lo que los autores consideran es una situación de relativa impredecibilidad.
