La presente tesis expone la problemática en materia de los derechos de reconocimiento, titulación y acceso a los recursos forestales de las comunidades nativas y campesinas asentadas en la cuenca media del río Napo en el Departamento de Loreto y tiene como objetivo determinar qué medidas deben ser tomadas por el Estado para que los derechos mencionados sean efectivamente cumplidos en la práctica. Asimismo se realiza un análisis sobre el dominio eminencial del Estado sobre los recursos forestales y la necesidad de aplicar un test de razonabilidad cuando este dominio eminencial colisione con los derechos de las comunidades nativas y campesinas.

The author critically exposes the problem that exists in the norms that regulate the procedures for the recognition and registration of legal status and the effective exercise of the native communities that still exist in the country.
