Esta obra es el fruto de la experiencia adquirida tras varios años de participar en la investigación, paralela a la labor de docencia, en los claustros universitarios, así como en el desempeño de nuestra labor como magistrado durante largo tiempo en el Poder Judicial. Reconocemos, sin embargo, que este trabajo deja planteados algunos temas por desarrollar para futuras investigaciones. Creemos que nuestra satisfacción se verá coronada en la medida que con la lectura de esta obra se logre el objetivo principal que nos mueve, cual es el de incentivar la investigación dado que el Derecho está en constante proceso de desarrollo con avances y retrocesos. El derecho es dinámico, como la vida que está en constante acción.

This paper analyzes the figures of ius trasmisionis and the right of representation. The latter allows descendants to inherit directly from the deceased, ensuring equitable treatment and following the mandate of the law. On the other hand, the right of transfer involves the transfer of inheritance rights when the original heir does not claim them within the established period. In this case, the person who did not exercise their right to the inheritance ends up passing it on to their own heirs.
