A través de este artículo se busca compartir con los lectores la experiencia ganada durante más de una década de docencia universitaria y de trabajo en programas orientados al fortalecimiento del Estado de Derecho y la buena gobernabilidad, a la defensa de los derechos humanos, al acceso a la justicia y a la reforma, y al mejoramiento del sistema de administración de justicia en el Perú y en la región andina, gran parte de los cuales ha sido financiada por la cooperación internacional. El presente trabajo elabora un análisis respecto al rol, posicionamiento y alcances de la autonomía de la voluntad de las partes en el mundo contemporáneo -especialmente en el Perú-en la elección de la ley aplicable a los contratos internacionales, y sobre el papel de los factores de conexión subsidiarios en el marco de un proceso judicial. This paper addresses the importance of Private International Law (hereinafter, PIL) in the modern world marked by an increasing human cosmopolitanism, the intensification of free trade of goods, services and capital, and by an avalanche of legal relationships, which daily cross the borders of states, greatly increasing international legal traffic. This paper analyzes the changes and contributions that the criminal procedure reform proposes and exposes the achievements and limitations subsequent to its implementation. The criminal procedure reform proposes different changes, such as, a greater emphasis on the accusatory, new roles for the operators of the justice system, speed of the process, allow the de-judicialization of the causes, among others. In effect, these changes derive from the objectives of reform: the reordering of the criminal prosecution system, pursuing the ideal of rapid and fulfilled justice, favoring the right to defense and guaranteeing respect for fundamental rights. This paper aims to study the main reasons that prevent law students and lawyers from contributing to the reform of Peruvian justice, also focusing on various reasons that should serve as a basis for them to commit themselves within the professional responsibility to contribute to the reform of justice in Peru. In the first part the impediments are developed, such as the silence that is complicit, the belief in what is foreign, the belief in the impossibility of change, the resistance to get involved in the public, the negative view about the reform, the loss of capacity for indignation and the belief that changes are few. After that, each of the factors explained is analyzed and the real reason behind each one is discovered, denying said impediments. The paper addresses the autonomy of will in the Peruvian Civil Code of 1984, focusing on articles 2095 and 2096. These allow the parties to freely choose the law applicable to a contract, without requiring a direct relationship between the selected law and the contract, which could lead to abuses such as the “internationalization” of contracts that are purely national. In this regard, the authors indicate that the intention of the parties to choose a certain law is due to their interest in achieving the application of a more permissive, or less prohibitive, law. They point out that the main problem lies in the fact that the Code does not contemplate the limitation of an “internationally permissible connection”.
