La presente investigación tiene por finalidad y objetivo demostrar que la Sentencia Casatoria No.2195-2011-Ucayali, al dificultar la interposición de demandas de desalojo, vulnera el derecho de acceso a la justicia; se emplearon los métodos analítico, deductivo-inductivo, y descriptivo-explicativo, la población fue los procesos de desalojo por vencimiento de contrato concluidos en el distrito judicial de Loreto y Lima durante los años 2014-2015; se tomó una muestra del treinta por ciento (30%) de dicho procesos, de forma aleatoria. Igualmente, se entrevistaron y se aplicó una encuesta a 30 magistrados, 20 abogados y 10 docentes universitarios de la especialidad.
