En la década del 90, a fin de dar seguridad a los inversionistas, se reguló la figura de los “contratos–ley”, los cuales contemplaban el arbitraje como mecanismo de solución de controversias; este ha sido empleado a lo largo de la última década por el supuesto incumplimiento imputable al Estado, específicamente a sus órganos regulatorios, a través de decisiones administrativas. Ello, ha generado lo que hoy conocemos como “Arbitraje Regulatorio”. Así, la presente mesa redonda busca ahondar sobre los puntos de controversia que han surgido por las actuaciones de este tipo de arbitraje y que, debido a su falta de regulación, aún no encuentran una respuesta absoluta.

En esta ocasión, el doctor Cantuarias desarrolla de manera muy interesante los diversos recursos impugnatorios contra el laudo arbitral CIADI, contemplados en su Convenio. Así pues, explica en forma muy concisa el recurso de aclaración y revisa. Respecto al recurso de anulación, el autor realiza un análisis más extenso y desarrollado, dejando en claro su excepcionalidad, y entrando a tallar el tema de la autoridad que conoce el recurso y sus efectos, para terminar con unas excelentes conclusiones, que le servirán de mucha ayuda a cualquier operador jurídico que desarrolle su práctica profesional en arbitraje.

In the framework of international treaties, with special emphasis on theBilateral investment treaty (Bit), various responsibilities for states that comprise arise. However , what happens when the courts of a country interfere contrary to international standards in full force and effect of an award, the impact caused in that state and that leading to be internationally liable to a Bit or FtA are studied in this essay. the author further analyze jurisprudence of investment arbitration tribunals in cases Saipem v. Bangladesh, ATA v. Jordan Frontier Petroleum v. Czech Republic and White Industries v. India, also focuses on the case of Peru; and urges members of a treaty respect the rules of the game.

The author makes a critical analysis of the current situation of the Arbitration in Peru, from various court decisions that have identified the standard of motivation that must have an arbitration award. In this way, the author indicates that the consequences of annulling arbitral awards by improper motivation, insufficient motivation or follow criteria of the Arbitral Tribunal are severe and it affects all the progress that has been obtained in the arbitration in these last two decades.

Through this paper, the authors comment on the application of the Convention on the Recognition and Enforcement of Foreign Arbitral Awards, approved in New York on June 10, 1958, through the review of the most relevant case-law of the main jurisdictions in arbitration in Latin America. The following article provides a review of the different ground for refusal of recognition that a party can use to oppose the recognition of an award, revealing the criteria used by the courts to enforce or deny recognition of a foreign award.

The globalized world demands increasingly complex contractual operations. In that context, businesses have implemented multiple related contracts with the aim of achieving a common goal.In this paper, the authors analyze the complex situation of the arbitration regarding multiple contracts. Through the review of relevant case-law, the various solutions that characterize arbitration between multiple contracts are described. Finally, the authors address the overlap of non-signatory parties in the context of multiple contracts.
