The United Nations Convention on the Law of the Sea, four decades after the adoption of its final text, has become the main source of the law of the sea applicable to human activities in the ocean. The almost planetary recognition and the almost indisputable validity of the Convention is based on its successful capacity to regulate the rights and obligations of the States in the maritime spaces established by it, as well as on its aptitude to adapt to the new realities and problems that the oceans face. Based on the analysis of the Convention, it seeks to understand the mechanisms that allow it to respond to the needs and interests of an international system in permanent change.

La Convención de las Naciones Unidas sobre del Derecho del Mar de 1982 (en adelante la Convención) estableció el régimen jurídico de la plataforma continental en su Parte VI (art. 76-85) y su Anexo II (junto al Anexo II del Acta Final). Como parte de este régimen se estableció, de manera novedosa, un nuevo concepto jurídico deplataforma continental, así como la posibilidad de que los Estados, en circunstancias específicas, puedan determinar los límites de exteriores de sus respectivas plataformas continentales más allá de las 200 millas medidas desde sus costas, para lo cual debe recurrirse a un órgano de carácter técnico que mediante recomendaciones emitidas puede hacer vinculantes y obligatorias los límites exteriores de la plataforma continental de un Estado. Este nuevo órgano creado por la Convención es la Comisión de Límites de Plataforma Continental.

The objective of this paper is to identify the public international law as an instrument for the design, conduct and monitoring of actions with international impact of the nascent Peruvian republic. For this purpose, it will begin with the definition of the main categories under study such as international law, foreign policy, national objectives, among others. Next, a series of key historical events will be analyzed, such as: the break with Spain (from the declaration of independence and its legal value, to the “Treaty of Peace and Friendship” of 1879); the border delimitation process and its value for the protection of the national territory; and finally, the generation of economic alliances through the signing of commercial treaties that maintained and expanded Peru’s international projection in order to achieve recognition as an independent State in the international community....
