Education has been enshrined in the 1991 Political Constitution as a social, economic, and cultural right. Consequently, the State is obliged to guarantee access to all inhabitants of the national territory at all educational levels, including higher education and specifically to all academic programs, regardless of their cost or if the institution offering them is not of a public nature. The purpose of this work is to analyze how the State can ensure access to undergraduate medicine programs offered by private universities. This would be accomplished through financing models, such as Income Contingent Loans (ICL), by assessing the costs of tuition for this program in various institutions across the country. El presente artículo analiza la intersección entre la inteligencia artificial y el derecho de autor en el marco legal peruano, examinando si herramientas como ChatGPT pueden ser consideradas sujetos de derecho y, en consecuencia, autoras de obras intelectuales. El objetivo es determinar si el reconocimiento de la inteligencia artificial como autora de contenido es viable dentro del ordenamiento jurídico vigente. El método empleado es un análisis normativo y doctrinal, basado en la revisión de la legislación peruana, la doctrina especializada y marcos regulatorios internacionales. Los resultados evidencian que el derecho de autor en Perú limita la autoría a las personas naturales, excluyendo a la inteligencia artificial por su falta de personalidad jurídica, conciencia y capacidad creativa autónoma. Income Contingent Financing (FCI) is one of the systems used in the world to finance admission to higher education. In Colombia it was regulated in 2018, but to date it has not started its operation, as there are legal, budgetary and other difficulties that have not allowed ICETEX to start up. In this article, the Colombian regulation of the FCI is analyzed in a historical key in front of its emergence and comparing it with the way it is used in other countries. The method of synthesis analysis has been adopted, in order to unstructure the object of investigation, to then synthesize its content and thus demonstrate and analyze each part of the structure of the mechanisms for financing higher education in Colombia.
