This work aims to study the contributions of deontological and communicative ethics of Kantian roots throughout history, focusing on the importance of these for the construction of a moral that serves as a basis for the study and practice of politics and law taking into account tells the principle of human dignity. The first part explains some categories and elementary details about morality that will serve to adequately understand the rest of the text, among which are personal morality, social morality, types of ethics, among others. This essay addresses two aspects of the reflections on human rights. First, the author develops an analysis of the individualism that exacerbates individuality to the point of disregarding the community and denying the responsibility of the individual in the development of others. In the second place, the questions that seek the abandonment of the cultural project that gave rise to rights: the Enlightenment and modern project. In each case, the ideas expressed imply a particular anthropological approach, as well as a position on the philosophy underlying human rights.

This article point out the progressive enrichment by which fundamental rights concept have gone through, providing to holders—government and individuals— not only rights, liberties, powers and immunity but also the obligation to respect, defend, guarantee and promote all them regardless the conduct displayed by the holder in this field. With this in mind, the author examines arbitration definition and main characteristics, highlighting its constitutional dimension proposing a systematic reading in accordance with fundamental rights.
