This article aims to analyse how the Peruvian legal system, in harmony with international human rights systems, protects the indigenous child’s right to access justice. The methodology applied is qualitative, documentary in nature. The results highlight the importance of promoting access to justice for indigenous children based on the special valuation of the principles of human dignity, equality and non-discrimination, and the best interests of the child, seeking to reverse any situation of vulnerability with differentiated treatment in the courts. At the beginning, the right of access to justice for indigenous children is addressed on the basis of international human rights instruments, followed by a review of the normative and jurisprudential mechanisms and public policy initiatives that the local legal system has in place to protect this right.

Based on the anthropological theory of José Ortega y Gasset and the narrative of Boris Pasternak, this research, with a qualitative approach and grounded theory design, seeks to understand the nature of the individual as an apparent subject of individual rights. El presente artículo realiza un análisis de la oficialidad de las lenguas indígenas u originarias en la Constitución Política Peruana vigente y otros dispositivos legales, asimismo menciona los principales pronunciamientos jurisprudenciales emitidos por el Tribunal Constitucional Peruano sobre derechos lingüísticos de los pueblos indígenas u originarios reconocidos como derechos fundamentales de orden constitucional, en aras de promover un Estado constitucional multicultural.

The objective of this article is to analyze the scientific literature regarding educational innovation in a theorical context. To this end, the research had a qualitative approach of documentary analysis type. We worked with a unit of analysis of 17 documents; on one hand, 4 dissertations, and, on the other hand, 13 articles indexed in Scopus that met the three exclusioncriteria proposed in the research: i) type of publication, ii) temporality criterion and iii) language criterion. The study concluded that educational innovation is a set of processes that, through new practices, seek improvement in institutional management, teaching performance and the learningteaching process of students, with the purpose of transforming and impacting positively, the education sector.
