La discriminación en nuestro país se ha convertido en uno de los fenómenos sociales más extendidos y preocupantes que existen en la actualidad, no solo por los distintos modos en los que se manifiesta, sino también por el hecho de que muchas veces este problema no se puede detectar tan fácilmente o, peor aún, llega a considerársele como algo “natural” por parte de la sociedad.Por esta razón, en el presente artículo, el autor nos brinda un panorama general acerca del tratamiento penal que se le ha dado a la discriminación al ser considerada como delito en el Perú, tomando en cuenta para ello el contexto histórico, social y político en el que se ha desarrollado esta conducta, así como los alcances, límites y problemas quese presentan en la aplicación de este tipo penal a la luz de algunos casos que se mencionarán a lo largo del artículo.

This paper analyzes the impact of Article 18, paragraph 3 of the new Code of Criminal Procedure, this is developed in relation to Article 149 of the Constitution of Peru. The aforementioned article of the new Criminal Procedure Code states that the penal system can not intervene in those cases where the communal authorities have already exercised their competence. Consequently, it is necessary to develop on which that competence is based. According to article 149 of the Constitution, the communal authorities have jurisdictional functions; in that sense, jurisdictional pluralism is being recognized in a broad sense. Likewise, it is necessary to specify which instances are authorized to perform said functions. Although the Peruvian State has promulgated norms to stop the discrimination in the labor and business scope even its implementation is deficient. In this way, it is the companies themselves that must carry out internal policies to apply those standards. The author, initially, addresses the development of discrimination in Peru within a phenomenon of naturalization of discrimination and from there as it becomes internalized by eliminating its own elements. Starting from treating differently those who are in a different condition. And when differentiations are made between individuals and these are for objective and reasonable justifications. In recent years, the constitutions of Colombia, Peru, Bolivia, Ecuador and Venezuela have recognized the power to administer justice to the authorities of indigenous communities. In Peru, for historical reasons, this recognition is expressed in relation to the authorities of the peasant and native communities. However, in many cases, this power is not exercised by the traditional leaders of the population, but by the people that the Judicial Power has appointed: the justices of the peace.
