This paper provides an overview of the institution of family, its dysfunctionality, and aspects related to the deviant behavior phenomenon while emphasizing on the role of the State in drafting punitive and preventive policies. On the other hand, the paper aims to promote a true mechanism for preventive social policies regarding family as the nucleus of society and as the main driver of change in our criminogenic context.

This article provides an overview of the functioning of mental disorder, trying to understand their symptoms and origin, taking special interest in hysterical pictures. At the same time, analyzing in the light of modern times the development that has experienced some disorders of the minds such as neuroses. On the other hand, it addresses the problems in the criminal system, especially the peruvian, and the proclivity to mitigate or exempt criminal sanctions to certain kinds of behaviors derived from psychic disorders.

This article gives a criminological perspective on hired killers in our country, in a special way shows the main psychosocial characteristics of the person who provides his "criminal work" in exchange for a benefit, generally economic, which reveals his lack of appreciation for the life of their peers and the generalized reproach of a society hungry for justice and drastic penal sanctions against crime. On the other hand, it addresses the problem of informal control systems, preventive work by the State and the importance of strengthening the formation ofthe individual through the family and primary social environments. The methodology to be used in the present work has theoretical nuances, referred to the academic field related to Criminology, analytical, deductive, and explanatory.

This article gives a criminological perspective in relation to modern criminal law and the figure of the devaluation of the action and the result in special crimes such as corruption in situations of national emergency, understanding the figure of devaluation as part of the unlawful element of the crime. On the other hand, it addresses the issue of public opinion as an important factor in the positive or negative assessment of an allegedly criminal act and its participation as a pressure and / or interest group before the State authorities against a fact of social relevance.

En consecuencia, es precisamente este último punto el que analizaremos a lo largo del presente trabajo, ya que sólo conociendo los principales hechos o circunstancias vividas por el agresor y que han contribuido a formar su personalidad nociva, podremos entonces, evitar que estos hechos sucedan en otros niños o adolescentes, o al menos persuadir para que no se repitan estas circunstancias. Así la presente investigación constituye un enfoque detallado en pos de averiguar una realidad oculta de los agresores sexuales de menores, ya que al investigar el pasado de un delincuente establecemos e identificamos el desarrollo de su personalidad y las bases de su formación.

La presente investigación esta relacionada a un tema por demás polémico y problemático para el Perú, y es que a lo largo del último año hemos podido observar como se ha acrecentado “el delito de violación sexual de menor de edad”. Este delito es hoy en día objeto de un profundo debate en los foros jurídicos y políticos del país debido a su gran incremento y que aun no se ha encontrado una verdadera solución al tema.
