This paper analyzes the potential attribution of international liability to States for the commission of terrorist acts. To this end, the author develops the international obligations in the fight against terrorism, their content, limitations and conventional and non-conventional normative frameworks. The author also analyzes the connection between the commission of a violation of an international obligation relating to the prevention and suppression of terrorism and the attribution of State liability.

Tras muchas décadas de esfuerzos normativos, la comunidad internacional está a punto de completar una tarea que se inició en el período de entreguerras y que, por aquel entonces, se frustró con el abandono de las Convenciones de Ginebra de 1937: la concreción de un marco jurídico global para la lucha contra el terrorismo internacional, una de las prioridades de la Asamblea General de las Naciones Unidas. Sin embargo, resta un (pen)último paso, quizás el más importante: culminar con éxito las negociaciones que se celebran en el seno de la ONU con vistas a la aprobación de un proyecto de convención general sobre el terrorismo internacional y la realización de la vocación universal de dicha convención, es decir, su adopción por la Asamblea General (o en el seno de una conferencia diplomática) y su aceptación por la generalidad de los Estados.
