El presente Trabajo de Suficiencia Profesional se realiza en base al análisis jurídico del Expediente de Derecho Público N° 829-2009/CPC, el cual versa sobre materias de protección al consumidor, procedimiento administrativo sancionador y derecho civil, a través del cual se desarrolla la falta al deber de idoneidad y de información oportuna y adecuada que atribuye la Sra. Celia Rosa Yupanqui Astete a la empresa LAN PERU. Al amparo de la Ley de Protección al Consumidor, se evalúa el deber de idoneidad y de información, siendo en el caso concreto deber de la aerolínea cumplir con informar correctamente sobre las tarifas que se ofrecen y la regulación que aplica respecto a cada tarifa, así como también los lineamientos que los usuarios deben conocer para abordar oportunamente sus vuelos. Dicho ello, la relevancia jurídica del análisis del presente Expediente reside en la aplicación de la regulación en materia de Protección al Consumidor por parte de la entidad administrativa encargada, el Indecopi, y la evaluación de esta entidad respecto al problema de asimetría informativa e incumplimiento al deber de información a cargo de LAN PERU; situación que evidencia la brecha que existe entre la información con la que cuentan las empresas sobre el producto o servicio ofrecido y bajo la cual sustentan la aplicación de sus políticas, y la información incompleta que las empresas ponen al alcance de los usuarios; la cual puede ocasionar confusión y que los usuarios tomen decisiones desinformadas que posteriormente les ocasionen algún tipo de perjuicio. |

In attention to the Consumer Protection Law, the duty of suitability and the duty to provide complete information is evaluated, being in the specific case the duty of the airline to comply with correctly informing about the flight fares that are offered and the regulation that applies with respect to each flight fee, as well as the guidelines that users must know to board their flights on time.
