Para lograr tal objetivo fue necesario analizar el proceso de investigación del Decreto Legislativo 1297 sobre el proceso tutelar en relación a la condición o situación de un menor; además de examinar la problemática actual de este proceso en la realidad práctica. Asimismo, revisar la normativa en derecho comparado sobre el proceso tutelar y el análisis jurisprudencial en materia de investigación tutelar, los cuales nos han permitido identificar las debilidades que presentan las instituciones que forman parte de este proceso. La metodología aplicada es el método cualitativo a través de la recopilación documental y técnica del fichaje para demostrar que, si se cumplió con los resultados esperados en la hipótesis formulada, por lo cual, es necesario brindar una propuesta modificatoria al Decreto Legislativo 1297 de diversos artículos contenidos en el Título II al Título VI que abarca el proceso de investigación tutelar con la finalidad de garantizar la protección y el desarrollo integral de un infante o adolescente.

In order to achieve such objective, it was necessary to analyze the investigation process of Legislative Decree 1297 on the guardianship process in relation to the condition or situation of a minor; in addition to examining the current problems of this process in the practical reality. Likewise, to review the comparative law regulations on the guardianship process and the jurisprudential analysis on the subject of guardianship research, which have allowed us to identify the weaknesses presented by the institutions that are part of this process.
