El plantear el problema de investigación, sobre la validez y eficacia de la prisión preventiva frente al principio de presunción de inocencia en el marco del nuevo sistema procesal penal, ha conllevado a tener como objetivos principales el determinar si las resoluciones fundadas emitidas en audiencia han sido corroboradas con una sentencia condenatoria al final del proceso; las mismas que han sido contrastadas en el presente trabajo de investigación con datos estadísticos , doctrina y resoluciones jurisprudenciales; resultando que si existe una clara protección del principio de presunción de inocencia al existir más del noventa por ciento de sentencias condenatorias en las resoluciones que declaran fundadas las prisiones preventivas. Arribando a la conclusión de que debemos proveer herramientas adicionales al Juez para poder conseguir el cien por ciento de efectividad en una medida que lo que busca es garantizar la presencia del imputado en juicio. |
