Tuvo como objetivo determinar los fundamentos constitucionales que respaldan la despenalización de los delitos de injuria, calumnia y difamación, en el Perú. A lo largo de la investigación se ha determinado que la regulación de los delitos contra el honor, esto es, la injuria, calumnia y difamación ha conllevado una colisión con el derecho a la libertad de expresión, considerándose que su penalización resulta ser excesiva y desproporcional; ello conllevó a plantear el siguiente enunciado: ¿Qué fundamentos constitucionales sustentan la despenalización de los delitos de injuria, calumnia y difamación en Perú? En virtud a ello y tras haber realizado un estudio correspondiente, se considera que los fundamentos constitucionales que sustentan la despenalización de los delitos de injuria, calumnia y difamación son el principio de mínima intervención del derecho penal y derecho a la libertad de expresión. En la presente investigación se utilizó los métodos deductivo, histórico y hermenéutico habiéndose realizado un análisis de dos sentencias en las cuales se identificó la colisión devenida entre el derecho al honor y el derecho a la libertad de expresión; considerándose que las mencionadas generaron una censura a periodistas cuyo trabajo es difundir información que es de interés público. Se llegó a la conclusión que la penalización de los delitos contra el honor resulta ser una medida desproporcional, toda vez que el derecho penal se rige por el principio de mínima intervención. Por otro lado, estas instituciones han generado censura en la difusión de información de interés público, limitándose de esta manera el derecho a la libertad de expresión que resulta ser una garantía para un sistema democrático, como lo es el Perú

Its objective was to determine the constitutional foundations that support the decriminalization of the crimes of libel, slander and defamation in Peru. Throughout the investigation, it has been determined that the regulation of crimes against honor, that is, libel, slander and defamation has led to a collision with the right to freedom of expression, considering that its penalization turns out to be excessive and disproportionate; This led to the following statement: What constitutional foundations support the decriminalization of the crimes of libel, slander and defamation in Peru? By virtue of this and after having carried out a corresponding study, it is considered that the constitutional foundations that support the decriminalization of the crimes of libel, slander and defamation are the principle of minimal intervention of criminal law and the right to freedom of expression. In the present investigation, deductive, historical and hermeneutical methods were used, having carried out an analysis of two sentences in which the collision between the right to honor and the right to freedom of expression was identified; considering that the aforementioned generated censorship of journalists whose job is to disseminate information that is of public interest. It was concluded that the criminalization of crimes against honor turns out to be a disproportionate measure, since criminal law is governed by the principle of minimum intervention.
