description El presente informe de tesis tiene como principal propósito determinar los fundamentos jurídicos para la regulación de la gestación subrogada y su influencia en los derechos reproductivos, en el Perú. De igual manera, se analizará la naturaleza jurídica, trámite y documentación de las técnicas de reproducción asistida en el Perú, por lo cual se hará una revisión del artículo 7º de la Ley General de Salud sobre el desarrollo de la gestación subrogada. Del mismo modo, se hará un repaso de los derechos reproductivos conexos al derecho fundamental de la salud al recurrir a la gestación subrogada y, se verificará la legislación comparada correspondiente. En consecuencia, se efectuará una revisión detallada de las principales bases teóricas y doctrina jurisprudencial nacional sobre la importancia de la regulación de la gestación subrogada en nuestro ordenamiento jurídico y su influencia en derechos reproductivos. Finalmente, se utilizará el método científico desde un enfoque básico – descriptivo, para poder formular conclusiones respectivas sobre nuestras variables de estudio, explicando las bases teóricas en concordancia con la discusión de los resultados obtenidos

Likewise, it will analyze the legal nature, procedure and documentation of assisted reproduction techniques in Peru, for which a review of Article 7 of the General Health Law on the development of surrogacy will be made. Likewise, a review will be made of the reproductive rights related to the fundamental right to health when resorting to surrogacy and the corresponding comparative legislation will be verified. Consequently, a detailed review will be made of the main theoretical bases and national jurisprudential doctrine on the importance of the regulation of surrogacy in our legal system and its influence on reproductive rights.
