description El objetivo del presente estudio es analizar el trabajo infantil, la inaplicación de la regulación de adolescentes que trabajan y su afectación a la doctrina de protección integral del niño y adolescente en Trujillo, en el año 2023, considerando uno de los decretos legislativos que permite la autorización para que los menores de edad trabajen de manera “formal”. La investigación que se ha desarrollado es de tipo explicativa y con diseño descriptivo simple, dado que se trata de evolución de variables, realizado con una muestra de 20 profesionales especializados en familia y Derecho Laboral. Como técnica principal se utilizó el análisis documental y como instrumento la entrevista. Los resultados destacan la necesidad de fortalecer el marco legal para garantizar la doctrina de protección integral del niño y adolescente. Este hallazgo respalda la idea de que un entorno legal sólido es indispensable para afrontar el trabajo infantil y asegurar el bienestar de los menores. Por otro lado, la complejidad del trabajo infantil requiere la implementación y reforma de leyes específicas, alineadas con los estándares internacionales y con mecanismos de aplicación efectivos. La legislación debe acompañarse de políticas públicas integrales que incluyan educación y protección social hacia los niños y adolescentes, es por ello que la protección constitucional debe complementarse con leyes específicas y políticas efectivas para garantizar que estos derechos sean efectivamente ejercidos. Así como también el derecho a la educación requiere políticas inclusivas que garanticen que todos los niños, independientemente de su situación laboral, tengan acceso a una educación de alta calidad. The research that has been developed is of an explanatory type and with a simple descriptive design, given that it involves the evolution of variables, carried out with a sample of 20 professionals specialized in family and Labor Law. Documentary analysis was used as the main technique and the interview as an instrument. The results highlight the need to strengthen the legal framework to guarantee the doctrine of comprehensive protection of children and adolescents. This finding supports the idea that a strong legal environment is essential to address child labor and ensure the well-being of minors. On the other hand, the complexity of child labor requires the implementation and reform of specific laws, aligned with international standards and with effective enforcement mechanisms. Legislation must be accompanied by comprehensive public policies that include education and social protection for children and adolescents, which is why constitutional protection must be complemented with specific laws and effective policies to guarantee that these rights are effectively exercised. Just as the right to education requires inclusive policies that guarantee that all children, regardless of their employment status, have access to high-quality education.
