El mismo que ha sido cuestionado en la presente investigación. Así las cosas, a través de la doctrina y legislación comparada que se ha tenido a la vista, se ha podido llegar a alcanzar nuestro objetivo general. Por tal razón es que después de finalizada la misma, se ha podido arribar a la siguiente conclusión: La presunción relativa de verdad como consecuencia de la rebeldía regulada en el proceso civil peruano debe ser derogada porque vista desde la estructura de toda presunción esta no es, en puridad, una presunción, además de no ser congruente con el sistema de valoración de la prueba que nuestro Código Procesal Civil propugna, también porque resulta muy difícil de romper la relatividad de tal presunción, así mismo esta presunción atenta contra el derecho a una adecuada defensa, contra la debida motivación, provocando que exista la posibilidad de que hechos falsos sean tomados como cierto, lo que contradice frontalmente el derecho a una decisión justa
