La muerte, renuncia, salir del territorio nacional sin permiso del Congreso o impedir las elecciones presidenciales, son supuestos también estipulados en la Constitución, que revisten situaciones fácticas; sin embargo, como ha venido aconteciendo en nuestra coyuntura nacional, permitir al Congreso está ejerciendo una interpretación difusa, que podría configurarse como arbitraria. En atención a ello, el propósito de esta investigación es la de describir las razones jurídico – políticas para que se proponga la derogación de dicha causal.
