description Objetivo: Determinar, tratamiento judicial de las demandas de habeas corpus por detenciones arbitrarias según el nuevo Código Procesal Constitucional. Materiales y Métodos: Investigación de tipo básica normativa, redescribir en parte el art. 34 ° del NCPC, de nivel descriptivo relacional entre inconstantes y de enfoque mixto (cuantitativo-cualitativo), población y muestra numérica, no experimental, sin manipular variable, basado en la observación rigurosa y de corte longitudinal. Resultados: Las acciones de habeas corpus se admiten a trámite el mismo día, pero el juez viene resolviéndolo en forma extemporánea, ello contraviene a las detenciones arbitrarias pues se afecta la integridad personal. Conclusiones: 52 % el Código Procesal Constitucional reguladora del habeas corpus no vendría protegiendo, garantizando y restableciendo derechos constitucionales de naturaleza individual o colectiva, acorde a la orientación convencional del Pacto Internacional de Derechos Civiles y Políticos, la Convención Americana sobre Derechos Humanos.
