In this research work it was determined that within the filiation processes in our country, the current trend is the inapplication through diffuse control of a series of articles included in the Civil Code of 1984, referring to substantive legal precepts and adjectives of the institute. of filiation. This position seeks to protect the interests of the child and adolescent in many of these rules restrict access by those to know their true biological identity, fundamental right enshrined in Article 2 paragraph 1 of our Constitution. In spite of this, it will be possible to corroborate in the series of jurisprudence commented that a correct and concordant analysis with the principle of the best interest of the child accounts for the need of a contextualized analysis of the specific case in order to truly safeguard the interests of the minor since in the processes of filiation challenge there is only a stripping of paternity, which is not replaced by another. All this not only in terms of the principle of biological truth but also the principle of primacy of family reality.
