El trabajo tuvo como objetivo determinar si la argumentación jurídica influyo positivamente en la motivación en el proceso penal en el Distrito Judicial de Ica, en el año 2019. Se brinda una investigación tipo básica con un diseño descriptivo–correlacional y tuvo como muestra 100 profesionales especializados en el derecho penal quienes fueron seleccionados con un muestreo no probabilístico de tipo intencional o criterial y se aplicó como instrumento el cuestionario que permitió medir la argumentación jurídica y la motivación en el proceso penal mediante sus indicadores. Asimismo, se logró demostrar como el argumento jurídico influye significativamente en la motivación del proceso penal en el distrito judicial de Ica, esto se ve reflejado en la tabla Nº 11 la cual nos indica que existe un coeficiente de Pearson de 0.981 que representa una influencia directa y significativa entre las variables de estudio. ----- The objective of this argument was to determine whether the legal argument positively influences the motivation in criminal proceedings in the Judicial District of Ica in 2019. A basic investigation is provided with a descriptive – correlal design and had as a sample 100 professionals specialized in criminal law who were selected with an intentional or criterial non-probabilistic sampling and the inquiry form was applied as an implement that allowed to measure legal argumentation and motivation in the criminal proceedings through its indicators. It was also possible to demonstrate that the legal argument significantly influences the motivation of criminal proceedings in the judicial district of Ica, this is reflected in Table 11 which tells us that there is a Pearson coefficient of 0.981 that represents a direct and significant influence among the study variables.
