description El presente trabajo de Investigación aborda el tema de Realidad y Problemática en el Sistema penitenciario, segmentando el tema referente a la Restricción al acceso de Beneficios Penitenciarios y su afectación a los fines preventivos de la pena para los delitos graves, asumiendo que los beneficios penitenciarios asumen un rol fundamental en la resocialización del interno; no obstante la restricción de beneficios penitenciarios afectarían la dignidad de las personas que tienen derecho a reintegrarse a la sociedad y para el logro de este fin debe de valerse del tratamiento necesario que le permita volverse útil a la sociedad cuando culmine su encierro dentro del establecimiento penitenciario; asimismo los Beneficios Penitenciarios son métodos que ayudan al interno durante su tiempo de reclusión por haber infringido una norma penal; sin embargo la restricción de éstos en algunos delitos graves vulneran los derechos de las personas ya que no se cumpliría con el principio de resocialización; sino que se estaría afectando la dignidad de la persona que tiene derecho a reintegrarse a la sociedad y como interno dentro de un establecimiento penitenciario tiene derecho a mantener y recuperar su integridad física y mental sin que éstos se vean afectados por ningún motivo; también que puedan desarrollarse en talleres idóneos de educación y trabajo dentro de un establecimiento penal. Los Beneficios Penitenciarios favorecen al desarrollo educativo, laboral y social del interno, pero sobretodo ayudaran a cumplir su condena con buena conducta y no vuelva a reincidir de alguna forma a cometer un nuevo delito y que al momento de reintegrarse a la sociedad no incite a otras personas a poder infringir las normas penales, logrando así cumplir el Fin Preventivo de la Pena.

Los Beneficios Penitenciarios favorecen al desarrollo educativo, laboral y social del interno, pero sobretodo ayudaran a cumplir su condena con buena conducta y no vuelva a reincidir de alguna forma a cometer un nuevo delito y que al momento de reintegrarse a la sociedad no incite a otras personas a poder infringir las normas penales, logrando así cumplir el Fin Preventivo de la Pena.This research work addresses the topic of Reality and Problems in the Prison System, segmenting the topic regarding the restriction of access to penitentiary benefits and its effect on the preventive purposes of punishment for serious crimes, assuming that penitentiary benefits assume a fundamental role in the re-socialization of the inmate; notwithstanding the restriction of penitentiary benefits would affect the dignity of the persons who have the right to reintegrate into society and for the achievement of this purpose must use the necessary treatment that allows it to become useful to society when it ends its confinement inside the penitentiary ; Penitentiary benefits are also methods that help the inmate during his time of imprisonment for having violated a penal norm; however, the restriction of these in some serious crimes violates the rights of the people since the principle of re- socialization would not be complied with; but it would be affecting the dignity of the person who has the right to reintegrate into society and as an inmate within a prison has the right to maintain and recover their physical and mental integrity without them being affected for any reason; also that they can be developed in suitable workshops of education and work within a penal establishment.
