description El presente trabajo de investigación titulado “La maternidad subrogada como técnica de reproducción asistida frente al vacío legal del Ordenamiento Jurídico Peruano”, tiene como objetivo: determinar la necesaria regulación en el Ordenamiento Jurídico peruano de las técnicas de reproducción asistida, como es la maternidad subrogada, para suprimir el vacío legal que presenta la Ley General de Salud N° 26842. Esta investigación es descriptiva y no experimental. Se empleó un cuestionario, que estaba dirigido a la población: abogados con especialidad civil del Distrito judicial de Piura En cuanto a los resultados, se obtuvo que 66.67% de los Abogados con especialidad civil del Distrito judicial de Piura manifiestan que no están de acuerdo con el accionar del Estado al no preocuparse en establecer una ley específica para un tratamiento adecuado de las técnicas de reproducción asistida y no bajo el artículo 7 de la Ley 26842 (Ley General de Salud). Es decir, están a favor de incorporar una Ley sobre las técnicas de reproducción asistida, para que sea respaldada por el Ordenamiento jurídico, y se pueda suprimir el vacío legal que existe. Se concluyó que la práctica de la maternidad subrogada en nuestro país es más frecuente, es por ello la necesidad de tomar en cuenta los modelos de la normativa internacional para que se establezca una Ley dirigida a cubrir el vacío normativo que existe en el Ordenamiento jurídico peruano sobre las técnicas de reproducción asistida.
